1. Acceptance of Terms
These Terms of Service (“Terms”) govern your use of the Apex Consumer Solutions public website and any information you submit through website forms operated by Apex Consumer Solutions LLC (“Apex,” “we,” “us,” or “our”).
By accessing the website or submitting information through a website form, you agree to these Terms. If you do not agree, do not use the website or submit information through it.
A separately presented and signed client service agreement governs paid Apex services, enrollment, fees, and related client obligations. These website Terms do not replace, override, or silently modify a signed client agreement.
2. About Apex Consumer Solutions
Apex Consumer Solutions LLC provides administrative consumer support services that may include:
- Consumer account review
- Collection-account review
- Debt validation and documentation support
- Identity-theft documentation support
- Administrative document preparation
- Intake, tracking, and follow-up support
- Consumer education and process clarity
- Authorized referral routing where appropriate
3. Scope Limitations
Apex is not:
- A law firm
- Legal representation
- A provider of legal advice
- A provider of financial advice
- A credit-repair company
- A debt-settlement company
- A debt-elimination service
Apex provides administrative account review, documentation support, process tracking, and related operational assistance. Any matter requiring licensed legal or financial advice may be declined or routed only with appropriate authorization.
4. No Guaranteed Outcomes
Apex does not guarantee:
- Deletion or removal of information
- Credit-score changes
- Creditor responses
- Collection outcomes
- Dispute outcomes
- Specific timelines
- Acceptance of any documentation by a third party
Results depend on the records provided, applicable law, and the independent decisions of creditors, collectors, reporting agencies, and other third parties outside Apex’s control.
5. Consumer Responsibilities
When using the website or submitting information, you must:
- Provide accurate information
- Provide only records you are authorized to submit
- Avoid impersonating another person
- Avoid submitting fraudulent or altered documents
- Keep contact information current
- Review documents before authorizing use or mailing
- Promptly report suspected account or identity misuse
6. Website Intake
Submitting a website intake or account-review form:
- Requests initial contact or review
- Does not automatically create a client relationship
- Does not guarantee that Apex will accept the matter
- Is not an emergency communication channel
- Should not be used for immediate court, law-enforcement, or statutory deadlines
Apex may decline, close, or refer a matter when it falls outside Apex’s scope or when required information is incomplete, inaccurate, or unauthorized.
7. Communications
If you submit an inquiry or become a client, you may receive operational communications related to your inquiry, appointments, requested callbacks, documents, account-review workflow, and service administration.
These Terms do not create unlimited marketing consent. Where marketing consent is requested, it is separate from operational communications and may be withdrawn according to the applicable communication and applicable law. Existing TCPA, SMS, call, and email disclosures presented at the point of consent remain in effect and are not weakened by these Terms.
8. Electronic Communications and Signatures
Where permitted, Apex may use electronic records, acknowledgments, and signatures for website interactions, intake, and related workflow steps. Enrollment, payment authorization, and other client obligations are controlled by the separately presented and signed client agreement and any related authorization documents.
9. Fees and Payments
- Browsing the website and submitting an inquiry do not create a payment obligation.
- Paid services, fees, recurring schedules, and cancellation terms are governed by a separately presented and signed client agreement.
- Payment-method information may be handled through authorized third-party payment processors, including Authorize.Net hosted payment-method setup workflows.
- Apex does not intentionally collect raw card numbers or CVV through the general website intake form.
- Apex does not store raw payment card numbers, CVV, or full bank-account credentials in the CRM. Apex may store processor profile identifiers, last-four digits, brand or bank labels, billing contact details, and related authorization metadata returned by the payment processor.
10. Intellectual Property
Apex branding, logos, website copy, graphics, software, layouts, and related materials are owned by Apex or its licensors. You may use the website for ordinary personal purposes related to learning about Apex services and submitting an authorized inquiry.
You may not copy, scrape, resell, republish, reverse engineer, or misrepresent Apex materials or brand identity without prior written permission, except as allowed by applicable law.
11. Prohibited Use
You may not:
- Use the website for unlawful purposes
- Attempt unauthorized access to systems, accounts, or data
- Introduce malicious code
- Scrape the website in a manner that burdens or abuses the service
- Impersonate any person or entity
- Submit fraudulent information or documents
- Interfere with website operation or security
- Misuse consumer or employee information
12. Third-Party Services and Links
Apex may use or link to third-party providers for hosting, communications, payments, document workflows, or related functions. Independent third-party websites and services are governed by their own terms and privacy practices. Apex is not responsible for those independent sites or services.
13. Availability and Modifications
Website features may change, be suspended, or become temporarily unavailable due to maintenance, security, capacity, or operational needs. Apex may update website content and workflows as the business evolves.
14. Disclaimer
The website and related informational materials are provided on an “as available” basis for general informational and intake purposes. To the maximum extent permitted by applicable law, Apex disclaims warranties that are not expressly stated in a signed client agreement. Nothing in these Terms disclaims liability for intentional misconduct or for rights that cannot be waived under applicable law.
15. Limitation of Liability
To the maximum extent permitted by applicable law, Apex’s liability arising out of or related to website use or website intake submissions is limited to direct damages that are reasonably foreseeable. Apex is not liable for indirect, incidental, special, consequential, or punitive damages, or for losses caused by third-party decisions, incomplete or inaccurate consumer submissions, or events outside Apex’s reasonable control.
This limitation does not apply where prohibited by law and does not replace remedies available under a separately signed client agreement.
16. Indemnification
You agree to indemnify and hold Apex harmless from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your unlawful misuse of the website, fraudulent submissions, impersonation, or other material violation of these Terms, except to the extent caused by Apex’s own intentional misconduct.
17. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules that would require a different result. Nothing in this section requires arbitration, waives class actions, or waives a jury trial.
18. Changes to Terms
Apex may update these Terms from time to time. When material changes are made, the effective / last-updated date at the top of this page will be revised. Continued use of the website after an update constitutes acceptance of the revised Terms to the extent permitted by law.
